Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents.
At the very outset, learned counsel for the petitioner submitted that he may be permitted to implead concerned Gaon Sabha as respondent in the array of parties.
Prayer aforesaid is allowed.
Learned counsel for the petitioner is permitted to do so during the course of the day.
Sri Brij Kumar Saroj, learned counsel holding brief of Sri Sudhir Bharti, learned counsel is present for Gaon Sabha.
Learned counsel for the petitioner may serve a copy of the petition upon learned counsel appearing for Gaon Sabha during the course of the day.
Present petition has been filed with a prayer that the Sub Divisional Officer, Tehsil Champianganj, Gorakhpur be directed to decide the case no. 00425 of 2018, computer case no. T2018053102100425 (Smt. Prabhawati Devi vs. Ram Nayan and others) under section 134 of U.P. Revenue Code, 2006 within stipulated period.
Learned counsel for the petitioner submitted that he has received a copy of the report, according to which possession has been handed over to the petitioner, however, final order has not been passed.
In such view of the matter, the present petition is finally disposed of with a direction to Sub Divisional Officer, Tehsil Champianganj, Gorakhpur - respondent no. 2 to expedite the hearing of the aforesaid case and decide the same, in accordance with law, expeditiously, preferably within a period of two months from the date of production of a self verified copy of this order before him provided the functioning of the court is not affected by any reason related to COVID-19 Pandemic, the advocates are not abstaining from work and there is no other legal impediment.
With the aforesaid observations/ directions, the present petition is finally disposed of.
