Heard learned counsel for the petitioner, and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"(i) to issue an appropriate order or direction to the respondent No. 1/ The Court of Additional Commissioner (Judicial First), Varanasi Region, Varanasi to decide the Appeal NO. C2016140000888 (Prabhawati Devi vs. Ram Pyarey), under Section 210 L.R. Act, pending before him within stipulated period as fixed by this Hon'ble Court."
The petitioner is aggrieved on account of pendency of his appeal filed against the order passed on an application filed by the respondents under Section 41 of the UP Revenue Code. This appeal has been preferred in the year 2016.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 1, Additional Commissioner (Judicial First), Varanasi Region, Varanasi to consider and decide the case expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him Order Date :- 19.12.2019 Priyanka
