Prabhatbhai vs State

In the backdrop of allegations levelled under Sections 363, 366 and 376 of the Indian Penal Code, the age of the victim on the date of commission of crime was 16 years and was allured by the applicant who married with the victim later on but that aspect will not wipe out the initial crime committed by the applicant and no power can be exercised under Section 439 of the Code. This application is rejected.
