Heard Sri V.D. Dubey, learned counsel for the petitioner and Sri Mata Prasad, learned Standing Counsel appearing for the State- respondents.
The present petition has been filed seeking to challenge the order dated 26.11.2019 passed by the State Government in terms of which the petitioner has been placed under suspension pending departmental proceedings.
Counsel for the petitioner has sought to assail the order of suspension by submitting that the charges which have been mentioned in the order of suspension are not made out against the petitioner.
Learned Standing Counsel appearing for the State-respondents submits that the recital of the charges in the suspension order is only of a prima facie nature and the order of suspension clearly discloses that a copy of the same has been marked to the Deputy Director of Panchayati Raj (Anushrawan Koshthak), U.P. at Lucknow for the purpose of giving a charge sheet to the delinquent employee.
Counsel for the petitioner at this stage makes a prayer that the departmental proceedings initiated pursuant to the order of suspension may be concluded expeditiously. He undertakes that the petitioner would cooperate with the inquiry.
Having regard to the aforementioned facts and circumstances of the case, the petition is disposed of with an observation that the departmental proceedings initiated against the petitioner pursuant to the order of suspension dated 26.11.2019 shall be proceeded with and concluded by the respondent-authority expeditiously, preferably within a period of three months from the date of submission of a certified copy of this order before the authority concerned subject to the cooperation by the petitioner.
