Civil Misc. Recall Application No. 379842 of 2017 alongwith delay condonation application no. 379838 of 2017 dated 16.11.2017 supported by affidavits seeking recall of the order dated 21.7.2017 are taken up.
Heard Shri Bharat Singh Pal, learned counsel for the petitioner on the application. No one appears on behalf of the respondent.
This application has been filed for recall of the order dated 21.7.2017 on the ground that the same has been dismissed for non prosecution. This is an incorrect statement since the writ petition was not dismissed for non prosecution rather it was dismissed as the court did not find any ground entitling the petitioner for grant of the reliefs, which are quoted in the order itself.
Therefore, the order being one on merit, no recall of the same is permitted. The application is misconceived and is accordingly rejected.
