JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 53593 of 2014 Petitioner :- Prabhat Kumar Bisaria Respondent :- Chancellor, C.S.A. University and others Counsel for Petitioner :- Arvind Srivastava Counsel for Respondent :- Shiv Nath Singh,Neeraj Tripathi
Hon'ble Sudhir Agarwal,J. Hon'ble Ifaqat Ali Khan,J.
1. Called in revise. None appeared to press this writ petition. Sri Shiv Nath Singh, Advocate, is present for respondents. In the circumstances, we ourselves have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“(i) a writ, order or direction in the nature of certiorari to quash the impugned order dated 1.9.2014 passed by respondent no. 3 (annexure No. 09 to this writ petition).
(ii) a writ, order or direction in the nature of mandamus commanding to the respondents to permit this petitioner to work till the age of 62 years as a teacher.
(iii) a writ, order or direction in the nature of mandamus commanding to the respondents to treat the petitioner as Assistant Professor, Department of Agriculture Biochemistry, Chandra Shekhar Azad University of Agriculture & Technology, Kanpur and allow him to continue in his service till 30.6.2017 on completion of 62 years of age.
(iv) a writ, order or direction in the nature of mandamus directing the respondent no. 1 to decide the representation dated 15.9.2014 and 18.9.2014 filed by the petitioner.”
3. We ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 30.5.2018 PS
