Heard learned counsel for the petitioners, learned counsel for the respondent no. 3 as also the learned A.G.A. and perused the material placed on record.
It comes out from the record that on the basis of a compromise outside the Court, one case under Section 125 Cr.P.C. has been dismissed as not pressed whereas the divorce petition has been decreed. Relevant copy of the order has been placed on record by means of an affidavit dated 26.04.2010.
It is, therefore, submitted that in view of the law laid down in the case of B.S. Joshi and others Vs. State of Haryana and another, reported in 2003 (46) ACC 779, the F.I.R. registered under Case Crime No. 46 of 2009, under Sections 498-A, 384, 389/34, 506 I.P.C. read with Section 3/4 Dowry Prohibition Act, Police Station-Mahila Thana, District-Lucknow, may be quashed.
Accordingly, the F.I.R. registered as Case Crime No. 46 of 2009, under Sections 498-A, 384, 389/34, 506 I.P.C. read with Section 3/4 Dowry Prohibition Act, Police Station-Mahila Thana, District-Lucknow, is hereby quashed.
Petition stands disposed of finally.
