On oral mention by learned counsel for the petitioner that the matter is extremely urgent as the election of students union is scheduled to be held on 1.11.2018, the record was sent for and the matter has been heard.
By means of instant writ petition, the petitioner has challenged rejection of his nomination form for the post of President of students union of Mathura Post Graduate College, Rasra, Ballia, which is affiliated with Jan Nayak Chandrashekhar University, Ballia.
It is not disputed before this Court that the election process is in progress with the issuance of election notification. The matter relating to alleged illegal rejection of nomination form could be subjected to challenge before the forum constituted by the University for adjudicating a complaint relating to election of students union.
Having regard to these facts, this Court is not inclined to entertain the challenge at this stage as it would amount to interference with the election process.
The writ petition is disposed of with liberty to the petitioner to seek appropriate remedy in accordance with law after election is held.
