Petitioner claims to have been appointed as Assistant Teacher in respondent no.4 Institution in the year 2000. The Institution then was not receiving any aid from the State. Subsequently on 13.04.2016 the Institution has been included in the list of aided institutions whereafter the petitioner has also staked to claim for release of salary out of State fund but her claim has not been considered. Submission is that petitioner’s name is duly recorded in manager’s return and she has been offered appointment in accordance with law but such claim is not being considered despite various representations.
Learned Standing Counsel States that such claim of the petitioner shall be examined in accordance with law.
In the facts of the present case this petition stands disposed of permitting the petitioner to represent her grievance before respondent no.2, annexing all materials in support of her claim together with a copy of this order within four weeks. The Director of Education shall afford an opportunity of hearing to respondent no.4 and shall ensure that an appropriate order is passed in the matter relating to payment of salary to petitioner out of State fund by the competent authority, within a further period of four months, thereafter. All consequential action shall be taken accordingly.
