Pursuant to the order passed by this Court an amendment application dated 08.02.2021 was filed by the counsel, the same is taken on record.
From perusal of the same, it appears that certain amendments were sought in the prayer clause of the petition.
The amendment application is allowed.
Learned counsel for the petitioner is permitted to make necessary amendment in the petition at appropriate places during course of the day.
Heard learned counsel for the petitioner and perused the record.
The petitioner is before this Court for a direction to Civil Judge (S.D.) Ballia, to decide the Case No.465 of 2009 (Surendra Shukla Vs. Prabha Shankar Shukla and another) within stipulated period.
In view of the order proposed to be passed, notices need not go to the private respondents.
It is argued by learned counsel for the petitioner that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
