Heard learned counsel for the petitioner.
On 11.12.2018, this Court passed the following order:
"Learned counsel for the petitioner prays for and is granted one week time to file supplementary affidavit bringing on record the fact as to when he has taken steps for service of notice upon the defendant and whether the court below has recorded any satisfaction with regard to the service on them.
Put up this matter on 20.12.2018 as fresh."
Supplementary affidavit has been filed today, which is taken on record.
Perusal of the affidavit shows that there is no averment that the court below has recorded any satisfaction with regard to the service of notices upon the defendants.
Considering the facts and circumstances of the case, this petition is disposed of finally with the observations that the court below shall make endeavour to decide the 6-C application of the petitioner in O.S. No.762 of 2018 (Prabha Kant Vs. Laxmi Kant and others), expeditiously, preferably within two months after affording reasonable opportunity of hearing to the defendants and without granting any unnecessary adjournment.
