Heard counsel for the petitioner and learned standing counsel appearing for the State respondents.
By means of the present petition under Art. 226 of the Constitution, seeks a direction in the nature of mandamus commanding the respondent no. 2-S.D.M., Barhaj, district Deoria to decide Case No. T-201905200400640, under section 25(1) of the Societies Registration Act, Prabandh Samiti Baba Gyadas Technical and others Vs. Tathakathit Prabhandh Samiti and others, within some specified period.
Contention of the learned counsel for petitioner is that the aforesaid reference under section 25(1) of the Act was filed on 11.3.2019 which remained pending since then. Certified copy of the ordersheet has also been filed which indicates that no effective order has been passed by the concerned S.D.M. till date.
After hearing learned counsel for the petitioner and learned standing counsel, the present writ petition is being finally disposed of by issuing a direction to respondent no. 2-S.D.M., Barhaj, district Deoria to decide Case No. T- 201905200400640, under section 25(1) of the Societies Registration Act, Prabandh Samiti Baba Gyadas Technical and others Vs. Tathakathit Prabhandh Samiti and others, in accordance with law as expeditiously as possible within six months from the date of production of a certified copy of this order. No order as to costs.
