Heard learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Uday Pratap Singh, learned counsel for respondent nos.2 to 4.
The petitioner by means of the present writ petition has sought a direction upon respondent no.1 to accord approval to agenda No.38:20:05 passed in the 38th meeting held on 14.07.2020 by the Executive Council.
The petitioner was working as Professor in Pandit Deen Dayal Upandyaya Pashu Chikitsa Vigyan Vishwavidyalaya Evam Gau Anusandhan Sansthan, Mathura. The petitioner having been completed ten years of service as Professor is entitled to certain pay bands under the scheme framed by the University Grants Commission (hereinafter referred to as 'U.G.C.'). The Executive Council has passed a resolution agenda No.38:20:05 in the 38th meeting held on 14.07.2020.
Sri U.P. Singh, learned counsel for the University, on instructions, which is taken on record, submits that agenda No.38:20:05 in the 38th meeting held on 14.07.2020 passed by the Executive Council has been forwarded to the State Government for its approval and the same is pending before respondent no.1.
The grievance of the petitioner is that though he has retired, but he has not yet been granted benefit of pay band which he is entitled to under the scheme framed by the U.G.C.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.1 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.1- Principal Secretary of Pashudhan, Government of U.P., Lucknow alongwith a copy of this order downloaded from the official website of High Court, Allahabad raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.1 shall decide the same by reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
