JUDGMENT / ORDER

This Writ petition is filed for direction to the respondents to remove the timbers stocked by the fifth respondent in Sy.No.P-23/149 and N-8/27 of Vadiveeswaram Village, Agasteeswaram Taluk, Kanyakumari District and further forbearing the fifth respondent from stocking the timbers in the above places any further based on the petitioner's representation dated 14.10.2010.
2.Heard Mr.P.Ranjitham, learned counsel appearing for the petitioner and Mr.G.Muthukannan, learned Government Advocate appearing for the respondents R1,R2 and R4 and Mr.P.Athimoola Pandian, learned counsel appearing for the 3rd respondent and Nr.S.Arunachalam, learned counsel appearing for the 5th respondent and perused the materials available on record.
3. The learned counsel for the petitioner would submit that the petitioner had been giving repeated representations to the respondents 1 to 4 to stop the fifth respondent to stocking timbers in Sy.No.P-23/149 and N- 8/27. Since no action was taken, the present Writ petition.
4.The learned counsel for the fifth respondent would submit that the fifth respondent has already removed most of the timbers stocked in the said survey numbers and he undertakes to remove the balance within a period of three months.
5.The learned counsel for the third respondent would submit that in view of the recent Judgment of the Hon'ble Supreme Court, the first respondent is to take action on the representation of the petitioner.
6. In the light of the above facts, the fifth respondent is directed to remove the entire timbers stocked as per his undertaking within a period of three months, failing which, the first respondent is directed to consider the representation of the petitioner and take action as per law as expeditiously as possible.
7.With the above directions, this Writ Petition is disposed of. No costs.
