High Court Of Kerala|19 June, 2014
|

JUDGMENT / ORDER

Petitioner is accused in Crime No.332 of 2014 of the Pariyaram Medical College Police Station for the offences punishable under Sections 341, 324 and 326 of the Indian Penal Code, is in custody from 10.06.2014 and seeks bail.
2. Learned Public Prosecutor has opposed the application. It is submitted that on 14.05.2014 at about 04.00 p.m., the petitioner attacked the de facto complainant and another with a wooden stick and caused fracture of skull of the de facto complainant.
3. Learned counsel submits that the petitioner, pursuant to the direction this Court issued in the order dated 03.06.2014 in B.A.No.3742 of 2014 surrendered before the investigating officer on 10.06.2014. It is submitted that this Court also referred to the injury the petitioner sustained in the incident.
4. On hearing both sides it is revealed that the weapon of offence is recovered. Petitioner is not reported to be involved in any other case from the Pariyaram Medical College Police Station. I am inclined to think that further detention of the petitioner is not required. Hence I am inclined to grant relief but subject to conditions.
Application is allowed as under:
(i) Petitioner is granted bail in Crime No.332 of 2014 of the Pariyaram Medical College Police Station and shall be released on bail (if not required to be detained otherwise) on his executing bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional magistrate and subject to the following conditions:
