The petitioner is the holder of Ext.P1 building permit for constructing a residential building. The petitioner wants to extract the ordinary earth from the site covered by the building permit.
In view of Ext.P2 Government Order, no permit is necessary for extracting ordinary earth from the site covered by the building permit. However, for transporting ordinary earth, 'P form' is necessary.
Accordingly, there shall be a direction to the third respondent to issue necessary 'P form' on being satisfied with the genuineness of the claim of the petitioner based on the building permit without insisting for No Objection Certificate. Needful shall be done within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
