The petitioner firm, an industrial unit manufacturing plastic containers, has approached this Court seeking for a direction to provide effective and adequate protection to carry out loading and unloading work in the business premises which is being obstructed by respondents 2 and 3.
2. According to the petitioner, the firm has its own permanent workers and the loading and unloading work carried out is very minimal which can be handled by its own permanent workers. The work involved is incidental and not of a regular nature.
3. An interim order had already been passed by this Court on 25/02/2013 permitting the petitioner to employ its permanent workmen, namely - (1) Mr.Byamardas (2) Mr.Munna Das (3) Mr.Subair Das (4) Mr.Biswajitnath and (5) Mr.Motilal Bauri and police was directed to ensure that no obstruction is being caused by respondents 2 and 3.
4. The learned counsel for the petitioner submits that the area in question is a scheme covered area and the petitioner intends to register its permanent workers under Rule 26A of the Head Load Workers Rules 1981. Under such circumstances, learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to approach this Court again, if any further cause of action arises.
Permission is granted. This writ petition is dismissed as withdrawn with liberty to the petitioner to approach this Court again, if any further cause of action arises.
