Since this appeal under clause 15 of the Letters Patent is directed against an ad-interim stay order granted by the learned Single Judge on 20.8.2009 and notice on the petition is made returnable on 9.9.2009, we are not inclined to entertain this appeal. However, in view of the grievance being made by the appellant who is respondent No. 5 in the Writ Petition, we direct that if present appellant i.e. respondent No. 5 in the Writ Petition files his reply affidavit by 28.8.2009, rejoinder affidavit, if any, shall be filed by 1.9.2009 and the matter shall be listed before the learned Single Judge for admission hearing on 3.9.2009.
It is made clear that we have not gone into the merits of the controversy between the parties.
Subject to the above, the appeal is dismissed.
Since the appeal is dismissed, the Civil Application does not survive and the same also stand disposed of.
