Heard Mr. Brahmbhatt, Ld. Advocate for the applicant and Mr. Gandhi, Ld. Advocate for the opponents. Mr. Brahmbhatt, Ld. Advocate for the applicant submitted that the appellant/applicant - plaintiff is not using the entire parcel of survey no. 1119, but he is using only 2100 yards out of the said property and the remaining portion of the land is being used by others including the opponents.
In above view of the matter and considering the facts and circumstances of the case and keeping open the rights of both the sides to agitate their claim, NOTICE returnable on 02/04/2012. Mr. Gandhi, Ld. Advocate for the opponents waives service of notice for the opponents. Till the returnable date, both the sides are directed to maintain status-quo.
