1. The present application is filed by the convict through his brother-in-law seeking temporary bail for a period of 30 days so as to be with his daughter, who is appearing for 12 standard science stream board examination. The examination is to be commenced by 18/03/2013 and ended on 23/03/2013.
RULE. Mr. R.C.Kodekar, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
Learned APP invited attention of the Court to the jail remarks and submitted that the conviction is recent one. He was convicted by judgment and order dated 31/12/2012. As on 07/03/2013, the convict has undergone 11 months and 24 days. He has enjoyed paroles twice and reported in time.
For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
Rule is made absolute.
Direct service is permitted.
