1. The present application is filed by the convict through jail seeking temporary bail for a period of 60 days so as to arrange for engagement of his daughter and also to undertake agricultural operation.
2. Rule.
Mr. Pujari learned APP waives service of rule on behalf of the respondent-State.
3. The applicant has been convicted for the offences punishable under section 302 of IPC to undergo life imprisonment as awarded vide judgment and order dated 12.5.2008 in Sessions Case No. 35/2006. By now, he has undergone 6 years, 5 months and 9 days as on 13.6.2012. Last, he was out on furlough in the month of January, 2012. Prior that to, he has enjoyed one temporary bail and two furlough and every time reported in time. Nothing adverse is reported against the convict.
4. Taking into consideration the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
