JUDGMENT / ORDER

Present application under Section 482 of the Code of Criminal Procedure, 1973 has been preferred by the applicants to quash and set aside the impugned FIR.
After the matter was argued for sometime and as the investigation is still in progress and it is yet to be concluded by the concerned Investigating Officer, Shri Popat, learned advocate appearing on behalf of the applicants seeks permission to withdraw the present application. However, has submitted that whatever the documents are available with the applicants with respect to the properties in question, which is alleged to have been taken by the applicants by coercion or under extortion, applicants shall produce before the concerned Investigating Officer. It is requested to make suitable observation that concerned Investigating Officer may also consider the same during the course of investigation.
In view of the above, present application is dismissed/disposed of as withdrawn. It goes without saying that whatever documents are collected during the investigation either from the complainant or even from the accused side, the Investigating Officer is bound to consider the same in accordance with law and on merits.
With this, present application is dismissed/disposed of as withdrawn. Rule is discharged. Ad-interim relief, if any, granted earlier stands vacated forthwith.
