Learned A.G.A. has raised preliminary objection and submitted that in the present petition, request has been made for the search of alleged detenue, who is in a wrongful confinement, and there is a specific remedy available under Section 97 of Code of Criminal Procedure, 1973 for the same. Therefore, the petition is not maintainable.
Accordingly, the petition is hereby dismissed with liberty to the petitioner to take appropriate remedy under Section 97 of Cr.P.C.
