1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
“(I) issue a writ, order or direction in the nature of mandamus commanding the respondents to grant seniority to the petitioner after taking into account the five years' services rendered by the petitioner in the U.P. Charma Vikas Nigam, the Small Industry, owned and controlled by Small Scale Industries Deptt. of Government of Uttar Pradesh as Clerk.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondents to grant promotional pay scale of Rs.4000-6000 to the petitioner since 1.08.2003, the date on which the junior to the petitioner, Shri Suresh Chand has been granted the same.
(iii) issue a writ, order or direction in the nature of mandamus commanding the respondents to grant seniority to the petitioner over and above Shri Suresh Chand, R.R.M. (Revenue Record Moharrir).
(iv) issue a writ, order or direction in the nature of mandamus directing the respondents to pay the differences of arrears to the petitioner.
(v) issue a writ, order or direction in the nature of mandamus directing the respondents not to make promotion of any Class III employee during pendency of the instant writ petition.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
