(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through his wife seeking temporary bail for a period 30 days so as to enable him to open the bank account for the cheques received by the Government towards compensation for the demolition of his house.
RULE.
Learned Additional Public Prosecutor Mr.H.K.Patel waives service of Rule and invited the attention of the Court to the jail remarks.
The convict is undergoing the sentence of life imprisonment for the offences punishable under Sections 302 and 34 of the Indian Penal Code passed in Sessions Case Nos.82 of 2007, whereby he was convicted vide judgment and order dated 29.04.2008. As on 14.06.2012, he has undergone imprisonment of 5 years 8 months and 4 days. He has enjoyed temporary bail on two different occasions and enjoyed furlough on two different occasions. On every occasion, he has reported in time. Nothing adverse is reported against the convict.
For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 20 (Twenty) days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees five thousand only) to the satisfaction of the jail authorities.
The convict shall surrender himself to the jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
