The present habeas corpus writ petition has been filed to seek release of the corpus, who is arrayed as petitioner no.1 herein.
It is sought to be contended by the counsel for the petitioners that both the petitioner no.1 and 2 had performed their marriage and there was no force or coercive on the petitioner no.1 and she was wrongly lodged in Rajkiya Bal Grih (Balika home), Kanpur.
On a pointed query made by the Court as to the maintainability of the habeas corpus writ petition as the girl has been sent to Nari Niketan under the directions issued by the competent court, no submission could be made by the counsel for the petitioners.
He only states that in the medical examination, the estimated age of girl was 18 to 19 years and hence there was no occasion for the court concerned to send the corpus to the Nari Niketan.
The order passed by the C.J.M. concerned has not even been appended with the writ petition.
For the aforesaid, the present habeas corpus writ petition is dismissed being not maintainable.
