Heard learned counsel for the applicant and learned AGA for the State.
The applicant is a victim as well as informant of the case. She has lodged the FIR under Sections 376D, 406, 506 and 323 IPC, P.S. New Agra, District Agra arising out of S.T. No. 590 of 2017 pending before Additional Sessions Judge/FTC, Agra.
It is contended by the counsel that opposite party nos. 2, 3 and 4 are accused offenders who are extending the threats and dire consequences to her in the event she comes and give testimony against them, for which she made repeated request to the authority concerned by registered post and NCR which are annexed as Annexure nos. 4,5 and 6. In all four applications she has given her address as New Agra, which shows that she is resident of Agra.
Under the circumstances, I am no inclined to transfer the case to any other place. However keeping in view the facts and circumstances of the case and the allegation made therein, the SSP, Agra/ Ist Additional Sessions judge/FTC, Agra is directed to ensure the safety and security of the applicant on the date of the her testimony during the trial.
With this observation, the application is disposed of.
