The petitioner has invoked the jurisdiction of this Court under Matters Under Article 227 of Constitution of India with a prayer to direct the court below to decide the interim maintenance application dt. 28.1.2019 in Domestic Violence Case No. 5143 of 2016, Smt. Poonam and another Vs. Virendra and others) within the stipulated period..
Learned counsel for the petitioner has submitted that the petitioner has filed an application under section 12 of Domestic Violence Act and moved application for grant of interim maintenance on 28.1.2019 which is still pending disposal and has been lingering-on, on one pretext or the other.
In view of the above the court below is expected to make all endeavour to decide the aforementioned case expeditiously preferably within a period of four months after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side and there is no other legal impediment in concluding the trial.
With these observations, the present Matters Under Article 227 of Constitution of India stands disposed of.
