Heard Sri Rajesh Yadav, learned counsel for the petitioner and Sri S.N. Shukla, learned Standing Counsel and perused the material brought on record.
The relief sought in this petition is for quashing the impugned order dated 11.05.2019 passed by respondent no.2/S.D.M., Tehsil Ghosi, District Mau.
Learned Standing counsel, on the basis of instructions, states that without confirmation of auction proceedings, the petitioner has deposited the auction money and as such, the same has been cancelled by impugned order dated 12.05.2019 At this stage, learned counsel for the petitioner stated that the auction money deposited by the petitioner may be returned to which learned Standing counsel stated that for such relief he may approach the competent authority.
Even otherwise, the impugned order does not suffer from any legal infirmity nor the petitioner has been able to make out a case for interference by this Court under Article 226 of the Constitution of India.
The petition lacks merits and is accordingly dismissed.
