Heard Mr. Anil Bhushan, learned Senior Counsel with Mr. Neelabh Srivastava, learned counsel for the petitioner and Mr. Pradeep Kumar, learned counsel for the intervener.
The petition challenges a show cause notice dated 30.5.2017 (Annexure-7). We are informed that the petitioner has not submitted her reply nor did she appear before the authority on the date, that was fixed in the notice. Keeping that in view and considering that interim protection has already been granted by this Court vide order dated 8.6.2017, counsel for the parties have agreed for disposal of the writ petition by the following order:
The petitioner shall submit her reply to the show cause notice dated 30.5.2017 (Annexure-7) within a period of ten days from today. The petitioner shall also place all supporting materials along with her reply before the concerned authority. The concerned authority shall consider the petitioner's reply and the supporting documents and decide the show cause notice as expeditiously as possible and preferably within a period of six weeks from the date of receipt of the reply. Till the show cause notice is decided, interim protection granted by this Court vide order dated 8.6.2017 shall remain operative. The respondents- authority shall decide the show cause notice on merits in accordance with law and uninfluenced by the order dated 8.6.2017. It is made clear that this Court has not expressed any opinion on merits of the case. It is open to the intervener to make an application for intervention before the concerned authority and if such an application is made, we direct the concerned authority to consider the application on merits in accordance with law.
The petition is, accordingly, disposed of.
