Heard learned counsel for the petitioner.
Learned counsel for the petitioner submits that the suit is pending since 2005 even then still issues has not been framed. The petitioner is a lady and bonafide purchaser of the disputed property. An impugned order has been passed in the suit that is why plaintiff is lingering in the case.
He further submits that a direction be issued to the Court F.T.C. (Junior Division)-2, Varanasi to decide the Original Suit No.158 of 2005 (Nanhku Singh and others vs. Bachau Singh and others) within a stipulated period.
Considering the facts of the case, without expressing any opinion on the merits of the petitioner's case, this petition is disposed of with a direction to the Court F.T.C. (Junior Division)-2, Varanasi to decide the Original Suit No.158 of 2005 (Nanhku Singh and others vs. Bachau Singh and others) in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one year from the date of production of certified copy of this order, if there is no legal impediment.
Accordingly, the present petition is finally disposed of.
