This writ petition has been filed for issue of mandamus, directing Senior Superintendent of Police, Bulandshahar and Station House Officer, P.S. Kotwali Dehat, district Bulandshahar (respondents-2 and 3) to ensure fair investigation in Case Crime No. 1454 of 2018, u/s 366, 498 I.P.C., P.S. Kotwali Dehat, district Bulandshahar and submission of police report u/s 173(2) Cr.P.C.
It is stated that the F.I.R. was lodged on 9.10.2018. Thereafter, one of the victim was recovered and her statement u/s 164 Cr.P.C. has been recorded on 29.11.2018, in which she has fully supported the F.I.R. version. Even then, the police is neither arresting the accused, nor proceeding in the matter.
In the facts of the case, the writ petition is disposed of with direction that Senior Superintendent of Police, Bulandshahar and Station House Officer, P.S. Kotwali Dehat, district Bulandshahar (respondents-2 and 3) shall ensure fair investigation in Case Crime No. 1454 of 2018, u/s 366, 498 I.P.C., P.S. Kotwali Dehat, district Bulandshahar and submission of police report u/s 173(2) Cr.P.C. in it, as early as possible, preferably within a period of three months from the date of production of a certified copy of this order.
