Heard Sri Vipin Kumar Singh, learned counsel for the applicant.
This application has been filed by the wife of opposite party for transferring Case No. 599 of 2019 (Jai Prakash Dubey Vs. Poonam Devi), under Section 13 of the Hindu Marriage Act, pending in the court of Principal Judge, Family Court, Jaunpur to Mirzapur.
It has been stated in the affidavit filed in support of the application that the applicant has a minor boy aged about two years and there is no source of income and she is residing with her mother who is a house wife. The applicant and his son are fully dependant upon her widowed mother.
Office report of 28.11.2019 is that the notice issued to the sole respondent by registered post fixing 31.10.2019 has been delivered.
Neither any vakalatnama nor any counter affidavit has been filed on behalf of the opposite party.
Considering the facts and circumstances of the case, this application is allowed and the aforesaid Case No. 599 of 2019 is transferred from Jaunpur to Mirzapur.
