JUDGMENT / ORDER

The petitioner, who apprehends arrest for the offences punishable under Sections 294(b), 323, 355 and 506(1) of IPC r/w Section 3(1)(x) of the SC & ST, Prevention of Atrocities Amendment Act 1989 in Crime No.169 of 2016 on the file of the respondent Police, has filed this petition seeking a direction to the learned I Additional Sessions Judge under SC & ST (P.A.) Act, Thanjavur to consider his bail application on the same day on merits.
2. Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondent.
3. Heard both sides.
4. Considering the facts and circumstances of the case, the learned I Additional Sessions Judge under the SC & ST, Prevention of Atrocities Amendment Act 1989, is directed to accept the surrender of the petitioner and consider his bail application on the very same day purely on the basis of merits and to pass suitable orders, in the event of the petitioner surrendering before the said court within 15 days from today and filing of petition seeking bail.
5. This petition is ordered accordingly.
