(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Pursuant to the previous order dated 27.6.2012, learned counsel for the contesting parties have taken necessary instructions and arrived at a limited consensus to the effect that impugned order dated 1.6.2011 of respondent No.2 shall not operate as far as recovery of further amount of Rs. 70,000/- from the petitioner and blacklisting of the petitioner for three years are concerned. The petitioner shall now be required to make a fresh representation in respect of the aforesaid two matters and upon such representation being made within a period of one week from today which shall be decided by respondent No.2 within 15 days thereafter, after affording to the petitioner an opportunity of hearing, if thought fit by respondent No.2. Accordingly a fresh order in respect of the overall recovery of Rs. 1,04,000/- from the petitioner as also in respect of blacklisting the petitioner shall be made on or before 07.8.2012 and such order shall operate in substitution of the aforesaid part of the impugned order dated 1.6.2011. Petition is disposed in the aforesaid terms and Notice is discharged, subject to the arrangement arrived at by the parties by consent, with no order as to costs.
