JUDGMENT / ORDER

Mr.Niral Mehta,learned advocate for respondents Nos.1 and 2, states that he has instructions to appear on behalf of respondents Nos.1 and 2, and shall file his Vakalatnama during the course of the day.
Heard Mr.Mihir Thakore, learned Senior Advocate with Mr.Kunan Naik, learned advocate for the petitioner, Mr.Niral Mehta, learned advocate for respondents Nos.1 and 2, Shri Rajkumar Devichand Oswal, respondent No.3, in-person, and Mr.Paresh M.Dave, learned advocate for respondent No.4.
When the matter is taken up today, Mr.Niral Mehta, learned advocate for respondents Nos.1 and 2, submits that the Sarpanch, Bopal Gram Panchayat, along with Talati-cum-Mantri, shall visit Bungalows Nos.11 and 12 belonging to the petitioner and respondent No.3 respectively, along with respondent No.4 (the Builder), on 01.03.2012, to carry out an inspection regarding the problem in the sewerage system. The inspection shall be carried out in the presence of the petitioner and respondent No.3. After studying the problem, respondents Nos.1, 2 and 4 shall work out a viable solution in a manner that solves the problem but does not adversely affect either the petitioner or respondent No.3.
The matter be listed on 12.03.2012.
Mr.Niral Mehta, learned advocate for respondents Nos.1 and 2 states that the seal applied to the sewerage line of the Bungalow of the petitioner shall be opened today and the entire area will be cleaned.
Direct Service of this order, today, is permitted.
