Shri P.K. Giri, learned Additional Chief Standing Counsel, on instructions, submits that after investigation, police report/charge sheet has been filed on 4 January 2019 before the competent court.
Shri D.S. Misra, learned counsel appearing for the applicant submits that provisions of the Immoral Traffic (Prevention) Act, 1956, has not been followed. Investigation was not carried out/ supervised by the authority specified, therein. In support of submission, learned counsel placed reliance on the decision rendered by the Supreme Court in Delhi Administration vs. Ram Singh, AIR 1962 SC 63.
Be that as it may, this Court in contempt jurisdiction would not enter into the disputed questions that are being raised by the learned counsel for the applicant.
The application is, accordingly, consigned to record with liberty to the applicant to take remedy before the appropriate forum in accordance with law, if so advised.
