Heard Sri Karunesh Pratap Singh, learned counsel for the applicant and learned A.G.A. for the State.
The only prayer made by the applicant is that a direction be issued to the court below i.e. Additional Chief Judicial Magistrate, Court No.2, Gorakhpur to take appropriate steps for summoning the accused persons in Case No.3595 of 2017 (Pooja Sharma vs. Ramesh and others), under Sections 147, 149, 323, 452, 427, 504, 506 I.P.C., Police Station Gulriha, District Gorakhpur, within a stipulated period.
Considering the facts of the case, without expressing any opinion on the merits of the case, this application U/s 482 Cr.P.C. is finally disposed off with a direction to the concerned additional Chief Judicial Magistrate to consider and decide the aforesaid case in accordance with law without granting unnecessary adjournments to either of the parties expeditiously from the date of production of certified copy of this order, if there is no legal impediment.
