Heard Mr Pankaj Agarwal, learned counsel for the petitioners and Mr Bhupeshwar Dayal, learned counsel for the respondent- Development Authority.
Counsel for the petitioners, on instructions, fairly submits that the petitioners are prepared to deposit the entire amount (Rs.74,03,641/-) with interest, if any, within a period of four months from today, i.e. on or before 30.9.2018 in four equal installments. He submits that the petitioners shall deposit first installment on or before 20.6.2018 and thereafter, shall keep depositing remaining installments on or before 15th of every month. His statement is recorded and accepted.
It is needless to mention that, if the petitioners fail to deposit first installment, it would be open to the respondent-Authority to take further steps that may be necessary in accordance with law. Further, it is needless to mention that, if the petitioners fail to deposit the remaining amount, as aforementioned, on or before 30.9.2018, it would be open to the respondent-Authority to take further steps that would be required in accordance with law. It is also needless to mention that this order is subject to outcome of Special Leave Petition (Civil) Diary No (s).1735 of 2018, arising from the judgment and order dated 6.10.2017 passed by this Court in CMWP No.1027 of 2015.
It is open to the respondent-Authority to inform the petitioners, in writing, about the interest, if any, they are liable to pay on the amount mentioned above. We also make it clear that the petitioners shall be liable to pay interest subject to outcome of the aforesaid SLP, pending in the Supreme Court.
Once the entire amount is deposited by the petitioners, the respondent-Authority shall release the map of the petitioners, if there be no legal impediment.
The writ petition is, accordingly, disposed of.
