ORDER:
Heard learned Counsel for the petitioner and learned Standing Counsel for respondents 1 and 2.
This Writ Petition was filed challenging the action of respondents 1 and 2 in cancelling the tender by proceedings dated 27.02.2008 after accepting the bid of the petitioner.
It is submitted by the learned Standing Counsel for respondents 1 and 2 that the third respondent who was in due paid the amounts and after receiving the amount, the loan documents were released to the third respondent. In view thereof, respondents 1 and 2 do not go ahead with the tender process and in turn cancelled the tender process. Having regard to the same, no cause survives for adjudication in the Writ Petition.
The Writ Petition is dismissed as having become infructuous. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
