~~~~~~~~~~~ The petitioner had approached this Court seeking for implementing Ext.P3 decision, which is recommended by the Secretary of the Municipality to the Council. By Ext.P3, the Secretary of the Municipality after conducting an enquiry into the matter observed that in order to avoid water logging appropriate measures have to be taken for constructing a 'Chapath'. The recommendation was given to the Council. The main contention urged by the petitioner is that no decision has been taken by the Council in this regard so far. 2. Though time was granted by this court to file counter affidavit, no counter affidavit has been filed.
3. Having regard to the aforesaid submission of the learned counsel for the petitioner, I am of the view that appropriate directions can be issued as under:
Council of the Municipality shall take appropriate follow up action with reference to Ext.P3 and necessary measures shall be taken, as early as possible, and not later than six months from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
