The petitioner is the third respondent in CMA No. 45/2010 on the file of the court of the Subordinate Judge of Thalassery. The first respondent has filed I.A. No. 3186/2012 therein seeking to convert the civil miscellaneous appeal into an appeal suit. The petitioner seeks an early consideration of I.A. No.3186/2012 in CMA No. 45/2010 in order to give a quiteous to the issue.
2. I direct the court of the Subordinate Judge of Thalassery to consider I.A. No. 3186/2012 in CMA No. 45/2010 expeditiously. Every endeavour shall be made to pass final orders thereon within a period of one month from the date of production of a copy of this judgment.
The Original Petition is disposed of.
