The issue raised in this writ petition is covered in favour of the writ petitioner as per the decision of this Court in Varghese v. State of Kerala [2014 (1) KLT 1077].
2. In view of the above, the writ petition is allowed. Ext.P3 is quashed and the third respondent is directed to take a decision on the request of the petitioner to accord pensionery benefits in terms of the judgment in Varghese’s case (supra). This shall be done within a period of three months from the date of receipt of a copy of this judgment. The petitioner shall also produce a copy of the judgment in Varghese’s case (supra) along with the copy of this judgment for compliance.
