JUDGMENT / ORDER

Petitioner is aggrieved by the non consideration of the replacement application placed before the Regional Transport Authority. 2. The learned Government Pleader, on instruction, submits that this is a case of variation beyond 25% as permitted in the Kerala Motor Vehicles Rules. The petitioner's stage carriage had originally the seating capacity of 43, which was replaced by a vehicle having seating capacity of 36. The present application is for further reduction of the seating capacity to 33. The matter is pending consideration before the Regional Transport Authority and the same is said to have been considered on 4.9.2014 and the petitioner's grievance is with respect to non-communication of the order.
4. In such circumstances, the Regional Transport Authority shall communicate the order within a period of three weeks from the date of receipt of a copy of this judgment. The petitioner shall have reserved his liberties to challenge the said order.
Writ petition is closed.
