The petitioner has sought for furnishing 30 items of documents to him from the third respondent under the Right to Information Act. Since those documents have not been furnished to him, the present writ petition has been filed.
2.The management of Colachel Muslim Muhallam has been taken over by the second respondent Wakf Board on 19.01.2010 and the third respondent has been appointed as the Executive Officer to supervise the Colachel Muslim Muhallam. Pursuant to that, the third respondent has also directed the fourth respondent to furnish all the documents immediately, as per their order dated 03.08.2010. In the mean while, since there was a proceeding pending in C.M.P.No.2274 of 2011 before the Principal District Munsif cum Judicial Magistrate Court, Eraniel, the documents were not furnished to the petitioner. Pending the writ petition, the proceedings in C.M.P.No.2274 of 2011 was withdrawn by the third respondent on 12.06.2015. As such, there is no impediment for the third respondent now to entertain the petitioner's request of furnishing the documents sought for by him under the Right to Information Act.
3.In the light of the proceedings in C.M.P.No.2274 of 2011 having ended on 12.06.2015 and in the light of the recommendation of the second respondent Board on 19.01.2010, the third respondent is directed to furnish copies sought for by the petitioner in his letter dated 11.11.2008, addressed to the third respondent. Such exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order.
4.With the above observation, this writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
