JUDGMENT / ORDER

The petitioner approached the Tahsildar by Ext.P3 to demarcate and determine the boundary under Form 10 of the Kerala Survey and Boundaries Act, 1961. Petitioner submits that on mistaken identity, the fifth respondent-Municipality is constructing a building in a land belonging to the petitioner.
2. The learned Standing Counsel for the Municipality submits that the Municipality is only undertaking construction within the land belonging to the Municipality and they have not encroached upon the petitioner's property.
3. There shall be a direction to the second respondent to take necessary steps to demarcate the petitioner's property with that of the Muncipality.

This shall be done within a period of one week. Till determination of boundary, status quo shall be maintained. Needful shall be done after hearing the petitioner and the Municipality.
