The Mediation Centre has sent a report pointing out that the matter has been settled on certain terms which have been reduced into writing and forwarded to this Court. 2. Learned counsel on both sides pointed out that a decree may be passed in terms of the compromise entered into by the parties before the Mediation Centre.
3. On going through the report and the settlement arrived at, there is nothing to show that there is any illegality or irregularity on the compromise arrived and there is no reason not to accept the same.
In the result, this appeal is allowed and the judgment and decree passed by the courts below are set aside and a decree is passed on the following terms.
1. Respondents shall execute and register the required conveyance, to transfer the title over 1.235 cents (0.50 ares) of land comprised in Survey No.554/2D block No.30 re-survey No.334/24 of Rayamangalam Village, which is actually under the ownership of late Varghese and 1st respondent, and now in possession of the appellants 2 and in favour of the appellants at the cost and expense of the appellants.
2. The appellants shall pay an amount of Rs.10,000/- to the respondents at the time of execution and registration of the conveyance as stated in the clause above.
3. The respondent was one of the partners of M/s. Seven Starts Metal, Vaduthala, Kochi, which was subsequently shifted to Keezhilam, Perumbavoor under the name and style M/s P.K.V Group Industries in which Sri.Mathew V. Mathew was also one of the partners. The 3rd respondent has retired from the above partnership firm in the year 1993. Hence the 3rd respondent or any other respondents herein shall not be liable and responsible for any assets, liabilities or claims by or against the said firms with effect from 31.05.1993.
The compromise shall form part of the decree.
