JUDGMENT / ORDER

The limited prayer in this petition is for a direction to the court concerned to dispose of I.A.No.8654/2014 (Ext.P2) in which ex parte order has been granted. Though objections have been filed, the I.A was not heard within period specified under the Code of Civil Procedure. 2. In the light of the limited prayer made in this petition which seems to be just and reasonable, it is felt that notice to the respondents is unnecessary. There is a statutory mandate directing the court concerned to dispose of the application in relation to which an ex parte order has been granted within 30 days of the order. In the light of the said provision, it is only just and proper that the direction sought for is granted.
This Original Petition is disposed of directing the court concerned to take up Ext.P2 application in relation to which ex parte order has been granted and dispose of it on merits, in O.P.(C) No.2561/2014 2 accordance with law, after hearing both sides. It is stated that the case stands posted to 19.11.2014. The court below may advance the petition or hear the same on 19.11.2014. The matter shall be disposed of as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a copy of this judgment.
