JUDGMENT / ORDER

The petitioner is a stage carriage operator running in the route Palakkad-Guruvayoor. The petitioner sought variation of his route which was declined by the Regional Transport Authority on the ground of objectionable overlapping. The petitioner challenges the same before the Tribunal. The Tribunal called for the records and on a perusal of the same, found that there is objectionable overlapping of 5.3 kms on the notified route. In such circumstances, there could be no interference on Ext.P5. The learned counsel appearing for the additional third respondent also asserts the overlapping in the verification now sought for. The writ petition would hence stand dismissed. However, the petitioner would be entitled to make a further prayer for variation, if so advised, with modifications, and in such circumstance, the authority would be competent to consider the same in accordance with law dehors the present rejection.
