The Civil Revision Petition is filed by the petitioner praying to direct the Principal District Judge, Trivellore to complete the trial proceeding in Election O.P.No.113 of 2006 and deliver judgment within a specific time.
2. Revision Petitioner filed Election O.P.No.113 of 2006 before the Principal District Judge, Trivellore for the following reliefs:-
(a) for recounting the votes polled on 15.10.2006, for the post of village panchayat President of Koovam Village, Tiruvalur Taluk, with the comparison of the counterfoils of the ballot papers, serial numbers with the polled votes and also the signature of the polling officers,
(b) for declaring the election of the First respondent as President of Koovam Panchayat as void and
(c) for declaring the revision petitioner as President of Koovam Panchayat.
3. The grievance of the revision petitioner is that in spite of petitioner's earnest endeavour to proceed with the Election O.P., the matter is being adjourned from time to time for recording evidence of respondents 4 to 6. Learned counsel for the revision petitioner states that according to Section 258(6) of the Tamil Nadu Panchayat Act, 1994, the Election Petition should be disposed of within six months from the date on which the election petition is presented to the District Judge for trial. Learned counsel for the petitioner, therefore, seeks suitable direction stating that the election petition should be disposed of at an early date.
4. The Election O.P.No.113 of 2006 has been filed on 25.10.2006. In view of the specific provisions as above in the Tamil Nadu Panchayats Act, 1994 there will be a direction to the Principal District Judge, Trivellore to dispose off the Election O.P.No.113 of 2006 expeditiously preferably before the end of October, 2009. The Civil Revision Petition is ordered accordingly. Consequently, connected miscellaneous petition is closed.
